On January 14, 2013, Chad Hemmat, founding partner at Anderson Hemmat, representing Don Etherton in Etherton v. Auto-Owner's Insurance Company, Case No. 10-cv-00892 commenced a two week trial in the Colorado Federal District Court. The trial resulted in the first significant Colorado jury verdict in the area of law known as statutory insurance bad faith (1115/1116).

Prior to trial, Auto-Owners Insurance offered only $1 to settle claims with Mr. Etherton. The jury found in favor of Don Etherton and against his auto insurance company and awarded an amount valued at or near $2,500,000.00.

See your trial lawyer in action! On May 15, 2015, Mr. Hemmat delivered, to a capacity crowd at the Colorado Trial Lawyers Association the opening statement that he presented to the jury on January 14, 2013.

Final Case Note 8/1/2016: In July 2016 the Federal 10th Circuit Court of Appeals upheld Don Etherton's 2.5 million dollar verdict ruling that the trial court and the judges were correct in finding in favor of Mr. Etherton and upholding his verdict. On July 28, 2016 Owners Insurance issued a check to plaintiff and Anderson Hemmat for the full value of the verdict, attorney fees and costs associated with this 6 year court battle.
