Drive High in Colorado, Get a DUI: But What Does High Really Mean?

Posted by: Chad Hemmat | Thursday, April 17, 2014 | 0 Comments

stoned driving accident lawyer denverColorado state law defines "driving under the influence of marijuana" as a driver who tests at 5 nanograms or more of active THC per milliliter of blood.

Critics charge that the 5 nanogram limit for marijuana is imprecise and arbitrary. Unlike alcohol limits that are measured based on the volume of alcohol consumed and the size of the consumer, intoxication levels with THC are not as easily determined. A CDOT spokesman recently admitted that one hit of marijuana can elevate an individual's THC level above the legal limit. The lingering nature of THC is also an issue. A recent study of over 700 Colorado drivers found that 21% of those drivers had blood results indicating that they had used marijuana within the past month. Another issue is the delivery of THC. While smoking marijuana can cause a more immediate high, edibles can take up to two hours to intoxicate the user. Continue Reading...

FedEx Tractor-Trailer Truck Crash Kills 10

Posted by: Chad Hemmat | Tuesday, April 15, 2014 | 0 Comments

semi-truck crashA FedEx tractor trailer driven by a long haul trucker heading northbound inexplicably crossed into southbound highway lanes striking a bus head-on that was full of high school students in Northern California. The deadly commercial trucking crash killed ten people, including the semi-truck driver and the bus driver.

While the National Transportation Safety Board (NTSB) continues to investigate, the evidence indicates that the truck took a slight 10 degree angle and crossed the median of the highway. Even though the bus driver clearly saw the truck and hit the brakes to avoid the collision (the bus created 175 feet of skid marks), the semi driver made no effort to brake at all before crashing into the front-end of the school bus. Common Questions About Personal Injury Claims in Denver, Colorado

The personal injury claims process can be complex. The Denver, Colorado accident lawyers at our personal injury law firm are here to answer your questions and help you along the way so that you can see a successful outcome to your personal injury case and claim. Below are some of the most frequently asked questions we receive about Denver accident cases and Colorado personal injury litigation. Click questions below to view the answers.

1) When does a personal injury accident case go to court?

Typically, a personal injury accident case will go to trial when a settlement agreement cannot be reached outside of courts. If the defendant in the personal injury case is refusing to offer a settlement that accurately reflects the extent of damages, then a trial might be the only option to secure maximum financial compensation.

2) How do I know if I should accept a personal injury settlement offer?

The best way to know whether or not you should accept a personal injury settlement is to consult with an accident lawyer you trust. Insurance companies try to get claimants to settle quickly before they know how much they actually could get for their accident. Consider having your personal injury case evaluated by a Denver accident attorney from our law firm.

3) How much does it cost to hire a Denver personal injury accident lawyer from your law firm?

Anderson, Hemmat & McQuinn operates on a contingency fee basis. This is a "no recovery, no fee" guarantee which basically states that you do not owe us attorney fees until we obtain a verdict or settlement for you. To learn more about payment options, please call our experienced accident attorneys directly.

4) Do I need an accident lawyer to handle my personal injury case?

While it is not mandatory that you have legal representation for a personal injury case, it can be extremely beneficial. Many people are cut short of the financial compensation because they were not aware of how much they actually deserved for their extensive accident.
