What to Do After a Car Accident in Colorado

The steps you take immediately after a car accident can significantly impact your ability to recover compensation. Here is what you should do:

Car speeding through the mountains
  1. Seek medical attention: Even if your injuries seem minor, see a doctor as soon as possible. Injuries like whiplash, concussions, and internal bleeding may not be immediately apparent. Medical documentation also provides critical evidence for your claim.

  2. Call the police: Colorado law requires you to report any accident resulting in injury, death, or significant property damage. The police report is often the single most important piece of evidence in a car accident claim.

  3. Gather evidence at the scene: Take photos of vehicle damage, the accident scene, road conditions, and any visible injuries. Collect contact information from witnesses and exchange insurance details with the other driver.

  4. Notify your insurance company: Report the accident to your insurer promptly. Be honest and detailed, but do not admit fault or downplay your injuries.

  5. Contact an experienced car accident lawyer: Before accepting any settlement offer or signing any documents from the insurance company, speak with a Denver car accident attorney. An experienced lawyer can protect your rights and ensure you receive fair compensation for your injuries and damages.

Types of Car Accident Cases We Handle

Our Denver car accident lawyers handle every type of motor vehicle collision. Click on any case type below to learn more about how we approach that specific type of claim.

Drunk Driving Accident Injury Cases

While those who drink and drive might face criminal DUI penalties, you may also be able to bring a civil case against them for the damage they cause, both emotionally and physically. Drunk driving accidents are often devastating, causing severe property damage, injury, and sometimes even the loss of a loved one. Our firm represents DUI accident victims with compassion and dedication so that they can receive full compensation.

Distracted and Texting Driver Accident Injury Cases

Distracted driving including texting, using social media, eating, and other activities behind the wheel is a leading cause of car accidents in Colorado. These crashes are on the rise and cause serious, often life-altering injuries. We have the experience with car accident cases you need to seek the compensation you deserve.

Uninsured and Under-Insured Motorist Accident Injury Cases

If you were hit by a driver without insurance or without enough coverage, you may still be able to pursue compensation through an uninsured motorist (UM) or underinsured motorist (UIM) claim. These cases require an experienced personal injury attorney who knows how to navigate Colorado insurance law.

Rear-End Accident Injury Cases

Rear-end accidents are the most common type of car accident in Colorado. These collisions may range from minor to severe, causing soft tissue injuries, whiplash, or even wrongful death at high speeds.

Multi-Vehicle Car Accident Injury Cases

Multi-vehicle accidents are complex to sort out when splitting liability and determining fault. Insurance companies will try to shift blame elsewhere and reduce what they pay. Professional representation makes all the difference because insurance companies know they cannot push a skilled personal injury attorney into an unfair settlement.

Single Vehicle Car Accident Injury Cases

Many serious injury cases involve only one vehicle but a faulty part, defective road design, or hazardous conditions caused the crash. We can examine your situation and determine if the blame lies with a manufacturer, government entity, or other party.

Head-On Collision Accident Injury Cases

Head-on collisions are among the most dangerous and deadly types of car accidents. The fatality rate is extremely high, especially at highway speeds. Common causes include falling asleep at the wheel, impaired driving, and distracted driving. Anderson Hemmat has recovered a $10 million verdict in a head-on collision wrongful death case.

T-Bone Accident Injury Cases

T-bone or side-impact collisions typically occur at intersections when a driver fails to yield or runs a red light. These accidents cause severe injuries because the side of a vehicle offers less protection than the front or rear. Severe injuries are highly likely at high speeds.

Vehicle Rollover Accident Injury Cases

Rollover accidents are extremely dangerous and cause catastrophic injuries including roof crush injuries, paralysis, and severe burns. Anderson Hemmat recovered a $2.6 million settlement in a car rollover case. Survivors often face long-term disability and need a lawyer who will fight for their full financial recovery.

We also handle truck accidents, motorcycle accidents, pedestrian accidents, bicycle accidents, bus and RTD accidents, rideshare accidents, and hit and run accidents throughout Colorado.

Common Car Accident Injuries

Car accidents cause a wide range of injuries, from minor to life-altering:

  • Whiplash: Soft tissue injury from the sudden jerking motion of the head during a collision, leading to chronic pain and limited mobility

  • Broken bones: Fractures to arms, legs, ribs, and other bones often requiring surgery and extensive physical therapy

  • Spinal cord injuries: Damage that can result in partial or complete paralysis, requiring lifelong medical care

  • Traumatic brain injuries: Concussions, skull fractures, and other head injuries causing cognitive difficulties, memory loss, and personality changes

  • Internal injuries: Damage to organs including the lungs, liver, or spleen that can be life-threatening and require immediate medical intervention

Colorado Car Accident Laws You Need to Know

Understanding Colorado car accident law is essential for protecting your rights after a crash.

Colorado Is an At-Fault State

Colorado is a tort or at-fault state, meaning the driver who caused the accident is financially responsible for the injuries and damages they inflict. You have the right to file a claim against the at-fault driver's insurance or file a personal injury lawsuit directly against them.

Modified Comparative Negligence (50% Rule)

Medical bill on table

Under C.R.S. 13-21-111, Colorado follows a modified comparative negligence rule. You can recover damages as long as your share of fault does not exceed 50%. Your compensation is reduced by your percentage of fault. For example, if you are 20% at fault and your damages total $100,000, you would receive $80,000. Insurance companies routinely try to assign more fault to you than is warranted, which is why having an experienced attorney matters.

Statute of Limitations for Car Accidents

Under C.R.S. 13-80-101, you have three years from the date of the accident to file a personal injury lawsuit in Colorado. If the accident resulted in a fatality, the family has two years from the date of death to file a wrongful death claim. Missing these deadlines permanently eliminates your right to seek compensation.

Colorado Minimum Insurance Requirements

Colorado requires all drivers to carry minimum liability insurance of $25,000 per person and $50,000 per accident for bodily injury, plus $15,000 for property damage (25/50/15). Colorado law also requires insurers to offer uninsured and underinsured motorist (UM/UIM) coverage, though drivers may decline it in writing. If you are hit by a driver with no insurance or insufficient coverage, your own UM/UIM policy may cover your damages.

Damages You Can Recover in a Car Accident Claim

If you have been injured in a car accident in Colorado, you may be entitled to compensation for:

  • Medical expenses: Past, current, and future medical bills including surgery, rehabilitation, medication, and ongoing care

  • Lost wages and earning capacity: Income lost during recovery and reduced future earning potential if your injuries prevent you from returning to your previous job

  • Pain and suffering: Physical pain and emotional distress caused by the accident and your injuries

  • Property damage: Repair or replacement of your vehicle and personal property

  • Loss of enjoyment of life: Compensation when injuries prevent you from participating in activities you previously enjoyed

  • Punitive damages: Additional damages in cases involving extreme negligence such as drunk driving or reckless behavior

How Insurance Companies Try to Minimize Your Car Accident Claim

Insurance companies are businesses focused on profit. After a car accident, adjusters will contact you quickly with a settlement offer designed to close your claim cheaply. Common tactics include:

Emergency in hospital
  • Quick lowball offers before you know the full extent of your injuries

  • Requesting recorded statements to use your words against you later

  • Disputing the severity of your injuries or claiming they were pre-existing

  • Assigning you more fault than you deserve to reduce your compensation under comparative negligence

  • Delaying the claims process to pressure you into accepting less

Having an experienced Denver car accident attorney levels the playing field. Insurance companies know which law firms settle cheaply and which ones fight. Anderson Hemmat is a firm that fights, and our $100 million in car accident recoveries proves it.

Why Choose Anderson Hemmat for Your Car Accident Case?

The Car Accident Claims Process in Colorado

Understanding how a car accident claim works helps you know what to expect. Our Denver auto accident attorneys guide you through every step:

  1. Free Case Evaluation: We review the police report, accident scene details, your medical treatment records, and insurance coverage to determine whether you have a viable car accident claim and what it may be worth.

  2. Investigation and Evidence Gathering: Our legal team collects accident reports, witness statements, medical records, surveillance footage, and expert opinions. In serious motor vehicle accidents, we may retain accident reconstruction specialists to establish exactly how the crash occurred.

  3. Medical Documentation: We work with your doctors to document the full extent of your injuries, ongoing medical treatment, physical therapy, rehabilitation needs, and any long-term disability or chronic pain. Complete medical documentation is critical for maximizing your compensation.

  4. Demand and Negotiation: Once your medical treatment stabilizes, we prepare a comprehensive demand package and negotiate aggressively with the at-fault driver's insurance company. Most auto accident claims settle during this phase when the insurer knows your car crash lawyer is prepared for trial.

  5. Filing a Lawsuit: If the insurance company refuses to offer fair compensation, we file a personal injury lawsuit in Colorado court. This triggers the formal discovery process where both sides exchange evidence under oath.

  6. Trial: If a fair settlement cannot be reached, your case proceeds to trial where a judge or jury determines fault and awards damages. Anderson Hemmat prepares every car accident case as if it is going to trial. That preparation is exactly why our settlements are consistently higher.

Determining Fault in a Colorado Car Accident

Establishing who is at fault is the foundation of every car accident injury case. In Colorado, fault is determined through police reports, witness statements, physical evidence from the accident scene, and sometimes expert accident reconstruction analysis. Several factors commonly establish fault:

  • Speeding: Excessive speed reduces reaction time and increases collision severity. Speed is a leading factor in fatal crashes on Colorado highways including I-25, I-70, and I-225.

  • Distracted driving: Texting, phone use, and other distractions are a leading cause of motor vehicle accidents in Denver and throughout Colorado.

  • Drunk or impaired driving: Impaired driving was a factor in more than one-third of Denver traffic fatalities in 2024. Victims of drunk driving accidents may be entitled to punitive damages in addition to compensatory damages.

  • Failure to yield: Running red lights, failing to yield at intersections, and improper lane changes cause thousands of auto accidents across Colorado each year.

  • Reckless driving: Tailgating, weaving through traffic, and aggressive driving on congested corridors like I-25 through Denver, I-70 through the mountains, and C-470 through the south metro area.

Remember that under Colorado's modified comparative negligence law, the insurance company will try to assign fault to you to reduce your payout. An experienced Denver car accident attorney can gather the evidence needed to protect your claim and counter unfair fault allocation. Contact our car crash lawyers at 303-782-9999 for a free evaluation of your case.

Car Accident Claim FAQs

While you are not legally required to hire an attorney, having one can significantly improve your chances of securing fair compensation. Insurance companies often try to minimize payouts, and an experienced attorney can negotiate on your behalf, gather evidence, and represent you in court if necessary. For more information or to see if we can assist you with your claim, contact our office at 303-782-9999.

Liability depends on how the injury occurred. Responsible parties may include negligent drivers (for car accidents), property owners (for premises liability cases), or other various situations. An attorney can help determine fault and build a strong case for compensation. For more information regarding the liability your potential claim, contact our office at 303-782-9999.

Under Colorado Revised Statutes C.R.S. 13-80-101, you have three years from the date of the accident to file a personal injury lawsuit. Missing these deadlines permanently eliminates your right to seek compensation. Contact Anderson Hemmat at 303-782-9999 to protect your rights before time runs out.

In most cases, no. Insurance companies typically make initial settlement offers quickly, often before the full extent of your injuries is known. These early offers are designed to close your claim cheaply and rarely account for future medical expenses, ongoing pain and suffering, or long-term lost earning capacity. Once you accept a settlement, you cannot go back and ask for more money. Always consult with an experienced car accident attorney before accepting any offer. Anderson Hemmat offers free case evaluations at 303-782-9999.

The timeline for a car accident claim varies depending on the complexity of the case, the severity of injuries, and whether the case settles or goes to trial. Simple cases may resolve in a few months, while complex cases involving severe injuries or disputed liability can take one to three years. It is important not to rush a settlement before you fully understand the extent of your injuries and future medical needs. An experienced car accident attorney will advise you on timing to maximize your recovery. Contact Anderson Hemmat at 303-782-9999.

Do yourself a favor and make Anderson Hemmat your first call if you’ve been involved in an automobile accident. My case was settled in less than 3 months from the date of my car accident. I was called last week with my settlement details and walked into their office the next day for my settlement check. This law firm worked hard to get me the largest settlement payout they could, even with a case that was complicated and less than desirable, due to the at-fault drivers lack of cooperation. One thing that stood out right away when I started working with this firm was feeling like you truly get their entire staff working on your case. I’ve worked with law firms before for personal matters and work related matters and I can say with confidence, you usually only get one attorney that you work with and one paralegal. That is not how Anderson Hemmat operates. Every time I had to call in I was delighted to talk with someone right away who knew all about the details of my case and could give me updates, answers and alleviate my concerns, even if I was talking to the staff member for the first time. I even had extensive phone calls with Cameron, Chad, Julie, and Jason where I could tell it was their goal to explain everything in detail to me, so that I felt comfortable and truly understood what they were trying to convey. Again, this is not always the individual attention and time you get with attorneys at other firms, but Anderson Hemmat seems to be the exception. I also worked with Evangelina and Beth who were wonderful and demonstrated excellent client service skills. I cannot recommend this firm enough for personal injury cases. They work so hard to get their clients compensated fairly and generously and more importantly, they treat you like you’re their most important case.

I shopped around for a little bit looking for a lawyer to take my case. All other prospects were slow to respond and due to covid19 didn’t want to see me or talk to me face to face. Chad Hemmat and his team responded right away, scheduled a meeting at their office to discuss the case. As soon as I signed on he got to work, his whole team has been very responsive and informative. I feel confident in their abilities to resolve my case and appreciate the time they take to keep me in the loop and informed on what’s going on. I would absolutely refer them and encourage anyone else to retain their services. Thanks again to the Anderson and Hemmat Team.
